How DWI Cases Move Through Buffalo City Court

Buffalo City Court handles misdemeanor charges, including most DWI and DWAI cases arising in the City of Buffalo, and its judges also sit as arraigning magistrates for felony charges, holding arraignments and preliminary hearings before a felony case moves to a higher court. If you were arrested for DWI in Buffalo, your case begins here: you will be arraigned, the charges and your driving privileges will be addressed, and the case will be scheduled before one of the court's sitting judges.

Cases in Buffalo City Court are prosecuted by the Erie County District Attorney's Buffalo City Court Bureau, which handles the highest volume of criminal cases in the DA's office. The court also operates several specialty parts (Drug Court, Veterans Court, Mental Health Court, and Opioid Intervention Court), and knowing when a case may qualify for one of these parts can significantly change its outcome.

Note that ordinary traffic tickets issued in the City of Buffalo are not handled here; non-criminal moving violations go to the Buffalo Traffic Violations Agency at 65 Niagara Square. Alcohol- and drug-related driving charges, however, are heard in Buffalo City Court.
