Frequently Asked Questions

What should I do if I'm arrested?
Remain calm, be polite, and exercise your right to remain silent. Do not answer questions or make statements without an attorney present. Ask for a lawyer immediately. Contact our office as soon as possible — the earlier we're involved, the better we can protect your rights.
What is the difference between a felony and a misdemeanor?
Felonies are more serious offenses carrying potential state prison sentences of more than one year. Misdemeanors carry a maximum sentence of up to one year in county jail. Both can have lasting consequences on your record, employment, and civil rights.
Can a criminal record be sealed in New York?
New York allows sealing of up to two criminal convictions (with no more than one felony) under CPL 160.59, if at least 10 years have passed since the sentence was completed. Certain offenses, including sex offenses and Class A felonies, are not eligible.
Do I need a lawyer for a misdemeanor charge?
Yes. Even misdemeanor convictions can result in jail time, fines, and a permanent criminal record that affects employment, housing, and professional licensing. An experienced attorney can negotiate reduced charges, alternative sentencing, or dismissal.
